Under current regulations, Mulberry House Limited only provides products and services to a client in an advisory capacity. This does not absolve any client from their legal duties and responsibilities.
The client is solely and wholly responsible for vetting and co-ordinating any advice, information or material received through Mulberry House Limited into its own activities according to the client’s own judgement.
Mulberry House Limited acts in good faith and the client warrants that Mulberry House Limited is in no way liable for any error, omission or matter arising in any way from Mulberry House Limited products or services.
Payment:
The client accepts that an invoice or receipt reflects the fact that the client has placed an order upon Mulberry House Limited as specified upon the invoice or receipt.
The client confirms and accepts these terms and conditions in full and with immediate effect.
Mulberry House Limited provides no credit or account facilities in order to maintain competitively priced products and services.
Payment is due by return and must have cleared in full before products or services will be shipped or supplied by Mulberry House Limited.
Un-cleared payment by the date of a booked on site service constitutes an un-notified cancellation by the client.
Refunds and Returns:
The client accepts that Mulberry House Limited operates a no refund policy and a no returns policy.
Consequently, products and services are not provided as “on approval”.
Cancellation Of An On-site Service Booking:
Cancellation only applies to on site booked services
The client agrees that cancellation can only be made by the client if done so in writing and sent by Recorded Delivery to Mulberry House Limited at Hingham Manor, Hingham, Norfolk NR9 4HP.
If Mulberry House Limited has not received written cancellation from the client within 7 days from the date of invoice the client accepts the on site service booking and these terms and conditions in full and without alteration.
If payment for a booked on-site service has not been made by the client and cleared by the date of the booked service this constitutes and un-notified cancellation by the client and 100% of the invoice total is due immediately. See (7) below.
The client agrees to pay Mulberry House Limited 75% of the invoice total where cancellation is received by Mulberry House Limited as per (2) above within 28 calendar days of the booked service date.
The client agrees to pay Mulberry House Limited 100% of the invoice total where cancellation is received by Mulberry House Limited as per (2) above within 14 calendar days of the booked service date.
Where written cancellation has not been received by Mulberry House Limited as per (2) above and the client has not paid in time for funds to have cleared in advance of the date of the booked service the client accepts that Mulberry House Limited will not provide the service due to non payment. In which case, the client agrees to pay Mulberry House Limited 100% of the invoice total overleaf plus administration and interest charges as deemed appropriate by Mulberry House Limited.
Transfers Of An On-site Service Booking:
The client accepts that an on-site service already invoiced by Mulberry House Limited can only be transferred to a revised date if agreed with Mulberry House Limited and confirmed immediately in writing by the client via Recorded Delivery and sent to Mulberry House Limited at Hingham Manor, Hingham, Norfolk NR9 4HP.
The client agrees to pay Mulberry House a Transfer Fee of 50% of the original invoice total plus the revised transfer invoice if the transfer is made within 28 calendar days of the of date of previously booked service. These must be paid and cleared prior to the service commencing.
The client agrees to pay Mulberry House a Transfer Fee of 80% of the original invoice total plus the revised transfer invoice if the transfer is made within 14 calendar days of the of date of previously booked service. These must be paid and cleared prior to the service commencing.
The client agrees to pay Mulberry House Limited 100% of each previous booking invoice plus the revised booking invoice if a booked service is transferred twice or more. These must be paid and cleared prior to the service commencing.
The client agrees that 100% of all booked on-site service invoices are due immediately if the client transfers a booking date and later cancels.
The client accepts that payment where a booking date transfer has not cleared payment prior to the booked service date constitutes an un-notified cancellation by the client.
Helpline and Update Services
These are free depending upon the nature of enquiry and service paid for.
To retain any relevant certification you must maintain access to the helpline and update services.
Three months prior to the anniversary of any relevant certification a renewal notice and invoice will be sent for those services.
If you wish to cancel the helpline and update services you must do so in writing by return of your having received the renewal notice and invoice.
If a renewal payment has not cleared by the anniversary of validation the services shall cease.
Upon cancellation or non-payment, certification of any relevant scheme will be withdrawn.
Price Increases
Mulberry House Limited may revise prices as and when it deems appropriate.
The Mulberry House Limited website, www.mulho.com, stated price at the time of ordering is the definitive price at that time.
Certification:
Certificates issued by Mulberry House Limited remain the property of Mulberry House Limited at all times.
Where the holder of a current certificate is found guilty of an offence under pertinent legislation or has clearly reached the spirit of its intended purpose, the client agrees to return certification to Mulberry House Limited via Recorded Delivery. No refund for certification charges is due to the client.
The client accepts that certification issued by Mulberry House Limited for a trainee is site specific.
Manuals and Materials:
The client accepts that any Mulberry House Limited product or service supplied is site specific and for use by employees, volunteers etc. employed by the client from that site.
The client accepts that they may not use any product or service supplied by Mulberry House Limited beyond the site to which it is licensed or registered.
To use a Mulberry House Limited product or service beyond the licensed or registered site and/or not for use by employees, volunteers etc. employed by the client from that site is not permitted and constitutes a breach of use for which the client agrees to compensate Mulberry House Limited as Mulberry House Limited deems appropriate.
Shipping:
The client accepts that Mulberry House Limited will not ship any order or certification until payment has cleared in full.
The Mulberry House Limited intent to ship any card order accepted and processed by midday on a normal business day is a service goal and not a contractual commitment.
Copyright:
The client accepts that reproduction in any way at anytime of any Mulberry House Limited product or material, except for its intended use at the registered or licensed site, is a breach of copyright for which the authorised and unauthorised users are both liable.
The client agrees to compensate Mulberry House Limited for breach of copyright as determined by Mulberry House Limited as Mulberry House Limited deems appropriate.
Mulberry House Limited vigorously protects its copyright, intellectual and other rights.
Independent Training Organisations:
Mulberry House Limited will only supply its products and services to businesses or organisations with care provision, related authority, inspectorate, agency, educational establishment activities etc.
Mulberry House Limited will not supply independent training organisations or private individuals. Any person placing an order upon Mulberry House Limited confirms they are neither a private individual nor purchasing for or on behalf of an independent training organisation. If it is subsequently discovered an order breached this aspect of our Terms and Conditions the purchaser accepts they will immediately return goods supplied via Special Delivery, at the purchaser's cost, forfeiting their purchase costs and compensating Mulberry House Limited by an additional payment of 100% of the total purchase cost immediately.
Acceptance and Alterations:
The client (purchaser) accepts these terms and conditions in full.
These terms and conditions may not be altered in any way.
